Injury Claim for Faulty Train Doors

Case Details:

If you travel on trains, you will be familiar with the various alerts that the doors are closing. Sometimes, there will be an announcement, “Stand clear of the closing doors”. Other times, it is just a beeping or audible signal. Train operators are legally required to alert passengers of closing doors.

However, on this day, as the woman boarded the train that had been stationary at the platform, there was no warning or beeping. The doors just unexpectedly rolled closed on her, crushing her shoulders.

The injury was painful and debilitating and would require months of treatment and rehabilitation.

Carbone Lawyers acted for the woman in claiming compensation against the train operators who challenged the woman’s claim that there had been no warning.

However, the TAC experts at Carbone argued that if there had been a warning, she could not have heard it, and besides, she had no expectation that the doors were about to close as the train was not scheduled to leave for another five minutes.

Outcome:

The woman received almost $200K, including costs for pain and suffering.
