Key Points:

    • Employers have a duty of care to protect their workers from injuries in the workplace.

    Summary:

A concrete pump worker who suffered an injury to his spine and right arm has received a large out-of-court settlement.

    Case Details:

The Plaintiff, a 35-year-old worker, suffered the injury when a concrete pump exploded due to a blockage while concrete was being pumped. Part of the Statement of Claim was that the employer failed to slow down or turn off the pump when the blockage occurred.

The man, a father of five, required ketamine infusions and steroid injections into his spine and extensive physiotherapy treatment.

    Outcome:

In addition to the large lump sum settlement for pain, suffering and lost earnings, the worker was entitled to keep the wages paid to him by WorkCover. The total settlement was equivalent to a jury verdict of nearly one million dollars. *
