Case Details:
Our client was visiting a friend who had just moved into a new rental property. While playing with his friend’s dog in the yard, he ran down the driveway.
It was getting dark, and there was no lighting. It was impossible to see the uneven ground and a small patch of grass in the driveway. He fell and fractured his leg so badly that it would require surgery to install plates and screws to hold the bone in place. There would be several other rounds of surgery after that to repair his leg.
To make matters worse, while in the hospital, the man suffered a bladder infection, which required treatment.
Carbone Lawyers acted for the man in making a claim against both the landlord and the managing agents. They argued that where the man fell was a hidden hazard that the owner and the property managers should have rectified.
Despite attempts to mediate an outcome, the matter was set to go to court
Outcome:
On the first day of trial, the defendants agreed to settle the matter for approximately $250,000 plus costs.
