Summary:
A man who initially had his claim rejected by the TAC, sues for damages and achieves a significant compensation payout within days of the trial commencing.
Case Details:
The client, a man in his late 40s, was riding his motorcycle through an inner-Melbourne suburb when a driver travelling in the opposite direction turned across his path, failing to give way.
In the collision, the man received severe spinal injuries requiring the fusing of multiple vertebrae. He subsequently suffered from referred pain in his lower limbs, as well as post-traumatic stress, anxiety and depression.
Before the accident, the man had been working in the building industry and was on a comfortable income. However, the accident left him incapable of returning to work in any capacity.
A Writ was issued in the Supreme Court of Victoria with the matter finally resolved at mediation.
A two-week trial was scheduled. However, on the fourth day, the matter was resolved, with the TAC agreeing to a significantly larger compensation payment.
Outcome:
The motorcyclist received $925,000, ensuring financial security for himself and his family.
